Terms & Conditions
Welcome to Juraj Gaspierik - Registered Architect & Engineer, an architectural and engineering practice based in Ireland. These terms and conditions apply to the provision of our services, which may include architectural and engineering design, project management, site supervision, and related services (collectively, the "Services"). By using our Services, you agree to these terms and conditions. If you do not agree to these terms and conditions, you may not use our Services. Please not that I also offer an independent, stand alone services of domestic Building Energy Rating Assessor in Ireland with a separate Terms & Conditions and Contract.
Scope of Services
We will provide the Services as agreed with you in writing, which may include the RIAI Standard Form of Agreement for the Appointment of an Architect or other relevant RIAI Standard Forms of Agreement. Our Services will be provided with reasonable care and skill and in accordance with any applicable laws and regulations.
Fees
Our fees for the Services will be set out in our proposal, contract, or other agreement with you, which may include the relevant RIAI Standard Form of Agreement or Contract. Fees are exclusive of any taxes or duties, which shall be the responsibility of the client. We reserve the right to charge interest on late payments at the rate specified in contract.
Intellectual Property
We retain all intellectual property rights in any designs, drawings, specifications, reports, or other materials prepared by us in connection with the Services. You may use these materials only for the purposes of the Services and with our prior written consent. You may not reproduce or distribute these materials without our prior written consent.
Confidentiality
We will keep all information that you provide to us confidential, except as required by law or with your prior written consent. We may disclose your confidential information to our employees, agents, or subcontractors who need to know such information for the purposes of providing the Services.
Liability and Insurance
We will carry professional liability insurance in an amount suitable for the Services provided. Our liability for any loss or damage arising out of or in connection with the Services will be limited to services provided by us. We will not be liable for any indirect, special, or consequential loss or damage, including but not limited to loss of profit or loss of use.
Termination
Either party may terminate our agreement at any time by giving written notice to the other party. Upon termination, you will pay us for all Services provided up to the date of termination. Any provisions that by their nature survive termination will remain in effect, including but not limited to those relating to intellectual property, confidentiality, liability, and insurance.
Governing Law and Jurisdiction
Our agreement and these terms and conditions will be governed by and construed in accordance with the laws of Ireland. Any disputes arising out of or in connection with our agreement will be subject to the exclusive jurisdiction of the courts of Ireland.
