Terms and Conditions for Building Energy Rating (BER) Assessment Services.

Welcome to the terms and conditions governing the provision of Building Energy Rating (BER) assessment services by Juraj Gaspierik, Domestic BER Assessor in Ireland. These terms and conditions apply exclusively to the services provided by the Assessor, including BER assessments and related compliance services. By engaging our services, you agree to adhere to these terms and conditions. If you do not agree to these terms and conditions, please refrain from using our services.

Scope of Services

The Assessor will provide the services as agreed upon in writing, specifically related to Building Energy Rating assessments, compliance assessments, and related services. All services will be carried out with reasonable care and skill, in compliance with applicable laws and regulations.

Fees

Our fees for the services are exclusive of any taxes or duties, which shall be the responsibility of the client. The Assessor reserves the right to charge interest on late payments at the rate specified in the contract.

Intellectual Property

The Assessor retains all intellectual property rights in any reports, assessments, or other materials prepared in connection with the services. You may use these materials exclusively for the purposes of compliance with regulations and the specific assessment in question, with the prior written consent of the Assessor. Reproduction or distribution of these materials without the prior written consent of the Assessor is strictly prohibited.

Confidentiality

All information provided to the Assessor will be treated as confidential, except as required by law or with your prior written consent. The Assessor may disclose your confidential information to our employees, agents, or subcontractors who require access to such information for the purpose of providing the services.

Liability and Insurance

The Assessor maintains professional liability insurance suitable for the services provided. The Assessor's liability is limited to losses or damages directly caused as a result of the Assessor's services. The Assessor will not be liable for any indirect, special, or consequential loss or damage, including but not limited to loss of profit or loss of use.

Termination

Either party may terminate our agreement at any time by providing written notice to the other party. Upon termination, you will be responsible for payment of all services provided up to the date of termination. Provisions that, by their nature, are intended to survive termination will remain in effect, including those related to intellectual property, confidentiality, liability, and insurance.

Governing Law and Jurisdiction

Our agreement and these terms and conditions will be governed by and construed in accordance with the laws of Ireland. Any disputes arising from or related to our agreement will be subject to the exclusive jurisdiction of the Irish courts.
